New Year, New Supreme Court

Senator Patrick Leahy claimed that some of Sam Alito's answers in his confirmation hearings contain "inconsistencies."

Liberals continue to insist that the Constitution is a living and breathing document that is open to interpretation. But as soon as it becomes a possibility that a non-Liberal might get on the Court they change their tune.

Now that there is a real possibility of having a "Conservative" Supreme Court, all of a sudden the Constitution is no longer a living and breathing document which is open to interpretation. Roe v. Wade is set in stone forever. Affirmative Action can never be challenged.

But if, as the Leftists on the Senate Judiciary Committee believe, the Constitution really is a "living, breathing document," why are so many or their judicially imposed doctrines off limits for change? Who's being inconsistent here?

The bottom line is that the Libs are in hysterics because much of what they have imposed on this country has been through judicial activism, and if they lose control of the Courts they will have to rely on the democratic process to advance their agenda. They'd rather not have to do this because the people might just not agree with their view of how the country should be run.

It seems ironic, but Democrats in general do not trust the democratic process. They'd much rather change the Constitution by judicial fiat rather than by the amendment process which requires the consent of 2/3 of the states. They'd rather filibuster judicial nominees than allow the full Senate to vote them up or down, unless they know the outcome will be in their favor.

The Constitution can be changed, but it has to be done according to the method outlined in the document itself, not by the whim of power-hungry judges.

Our Founders put this country together very smartly. They created a system whereby the people have the ultimate control over how they are governed. Where power is split up into three separate branches with three different functions. The Supreme Court was meant to be the least powerful of the branches, because it's the furthest removed from the people.

It's time for the Democrats on the Judiciary Committee to put their partisanship on the shelf and do their constitutional duty which is merely to confirm the qualifications of the candidate, not to make sure the candidate agrees with the Liberal interpretation of various rulings and other constitutional issues. It wouldn't hurt for them to read the constitution either; some in the GOP could benefit from this, too.
